BIR Online Tools for Travel Agencies and Tour Operators
A travel agency or tour operator withholds tax on at least three different kinds of payment in a single booking cycle, each under a different rule: a freelance tour guide’s fee falls under the 5%/10% professional/talent-fee bracket, a van or transport contractor falls under the 2% general contractor bracket, and office rent paid to a landlord falls under the 5% rental bracket. A VAT-registered agency has a further, independent RELIEF SLSP obligation on top of all three.
This guide is part of the site’s BIR Online Tools coverage and builds on BIR Form 2307 for Travel Agencies and Tour Operators. It covers tour guide fees, transport contractor payments, office rent, RELIEF SLSP, and a worked multi-vendor example.
Generate Your Tour Guide and Supplier Certificates FREE →Why does a travel agency face three different withholding questions at once? #
A travel agency typically pays a freelance tour guide, a transport contractor, and a landlord in the same month, and each one sits under a different part of the withholding rules — not one blanket rate. A freelance guide paid directly for leading a tour is an individual rendering a professional or talent service; a van operator contracted to run airport transfers or a multi-day tour circuit is a contractor providing a transport service with a driver, not simply leasing a vehicle; and a landlord collecting monthly rent on the agency’s office is neither of those — it’s a payment for the continued use of real property. Treating all three the same, or treating none of them as withholdable, is the most common way a small agency’s withholding comes up short at audit.
Freelance tour guides: the 5%/10% professional/talent-fee bracket #
A freelance tour guide paid directly by the agency — rather than billed through a DOT-accredited tour guide corporation — falls under the same 5%/10% individual professional/talent-fee bracket that covers consultants, translators, and other individually rendered services. As reproduced across BIR compliance references summarizing Section 2.57.2(A) of RR No. 2-98, as amended by RR No. 11-2018:
Professional fees, talent fees, commissions and any other form of remuneration for the performance of services rendered are subject to expanded withholding tax at the applicable rate depending on the payee’s classification and income level.
— Section 2.57.2(A) of Revenue Regulations No. 2-98, as amended by RR No. 11-2018, as reproduced across BIR compliance references summarizing the provision.
A guide whose cumulative gross income from the agency has not exceeded ₱3,000,000 for the year, with a sworn declaration of that fact on file, is withheld at 5% under ATC WI010; a guide who exceeds the threshold, or has no declaration on file, is withheld at 10% under ATC WI011. A guide operating through a registered tour-guide corporation instead draws the corporate equivalent, WC010/WC011.
Transport contractors: the 2% contractor bracket, not equipment rental #
A van, car, or bus operator hired on a contract basis to run airport transfers, a day tour, or a standing multi-day shuttle generally falls under the 2% general contractor bracket, not the 5% equipment-rental rate. The distinction turns on what’s actually being paid for: a genuine equipment lease, where the agency takes possession of a specific vehicle for its own exclusive use, is a 5% rental under Section 2.57.2(B); a transport service — a driver, fuel, and route included — is a contracted service under the same 2% bracket (ATC WI120 for an individual operator, WC120 for a corporate transport company) that covers trucking and hauling contracts elsewhere on this site. Most tour-van arrangements an agency books are the latter.
| Vendor | What’s actually paid for | Treatment | ATC |
|---|---|---|---|
| Freelance tour guide | Individually rendered professional/talent service | 5%/10% professional fee | WI010 / WI011 |
| Van/transport operator (contracted service) | Driver, fuel, and route included | 2% general contractor | WI120 / WC120 |
| Office landlord | Continued use of real property | 5% rental | WI100 / WC100 |
Office rent and RELIEF SLSP #
Office rent is a separate question from either vendor type above, and a VAT-registered agency carries a third obligation on top of withholding: reporting its sales and purchases on quarterly RELIEF SLSP. Rent paid to a corporate landlord is withheld at 5% under ATC WC100 (WI100 for an individual landlord) under Section 2.57.2(B) of RR No. 2-98. Separately, an agency that is VAT-registered must report its package-tour sales and its purchases — transport contractors and tour guide fees included — on RELIEF SLSP every quarter regardless of amount, since RR No. 1-2012 removed the older peso thresholds for that filing. An agency registered under percentage tax instead of VAT has no RELIEF SLSP duty, though it may still be a withholding agent on its guide, transport, and rental payments.
Worked example: Palawan Island Hop Travel’s one-week booking cycle #
Palawan Island Hop Travel books a freelance guide, a van operator, and pays its monthly office rent in the same week. The figures are fictional.
| Payee | Arrangement | Amount | Treatment | ATC |
|---|---|---|---|---|
| Freelance tour guide (individual) | 2-day island-hopping tour fee, sworn declaration on file | ₱18,000 | 5% professional fee = ₱900 withheld | WI010 |
| Sunrise Vans Corp. (transport contractor) | Contracted airport transfers for the week | ₱15,000 | 2% general contractor = ₱300 withheld | WC120 |
| Landlord (corporation) | Monthly office rent | ₱25,000 | 5% rental = ₱1,250 withheld | WC100 |
Palawan Island Hop’s bookkeeper compiles all three payees — guide, van operator, and landlord — into one listing with each payee’s name, TIN, amount, and ATC, and uploads it to the bulk BIR Form 2307 generator to produce all three certificates in one batch. If Palawan Island Hop is VAT-registered, the same transport and guide payments also appear on its quarterly RELIEF SLSP purchases listing, uploaded separately to the RELIEF module.
Pre-filing checklist for a travel agency or tour operator #
- Classify each guide’s or driver’s arrangement — an individually rendered service (professional/talent fee) versus a genuine equipment lease (rental) versus a contracted transport service (general contractor) — rather than defaulting to one rate for every vendor.
- Confirm a sworn declaration is on file for each guide claiming the lower 5% rate, or default to 10%.
- Separate rent from service payments when building the payee listing; rent uses WI100/WC100, not WI120/WC120.
- Upload the full withheld-payee listing to the bulk BIR Form 2307 generator each period.
- If VAT-registered, separately compile the quarter’s package-tour sales and purchases for the RELIEF module, regardless of how small any single transaction was.
Frequently asked questions #
Does a travel agency need to withhold tax on a freelance tour guide’s fee? #
Yes. A freelance tour guide paid directly by a travel agency or tour operator, rather than through a DOT-accredited tour guide corporation, generally falls under the 5%/10% individual professional/talent-fee bracket under Section 2.57.2(A) of Revenue Regulations No. 2-98, as amended by RR No. 11-2018 — 5% if the guide’s cumulative gross income from the agency for the year has not exceeded ₱3,000,000 and a sworn declaration is on file, 10% otherwise.
What withholding rate applies to a van or transport operator hired for airport transfers and day tours? #
A transport contractor hired on a contract basis for airport transfers, day-tour vans, or a standing shuttle arrangement generally falls under the 2% general contractor bracket under RR No. 11-2018, using ATC WI120 for an individual operator or WC120 for a corporate transport company. This differs from a straight 5% equipment rental, which applies when the agency rents a specific vehicle for its own exclusive use rather than contracting a transport service with a driver.
Does a travel agency withhold tax on its office rent? #
Yes, if the landlord is being paid for the continued use of real property and the agency is engaged in trade or business. Rent paid to a corporate landlord is withheld at 5% under ATC WC100; rent paid to an individual landlord uses ATC WI100. This is separate from any withholding on tour guides or transport contractors.
Does a travel agency need to file RELIEF SLSP? #
Only if it is VAT-registered. A VAT-registered travel agency must report both its package-tour sales and its purchases — including transport contractors and tour guide fees that are withheld — on quarterly RELIEF SLSP alongside BIR Form 2550Q, regardless of how small any single transaction was, since RR No. 1-2012 removed the old peso thresholds for this filing. An agency registered under percentage tax instead of VAT has no RELIEF SLSP obligation.
Can BIR Online Tools generate certificates for both a tour guide and a transport contractor from the same upload? #
Yes. The bulk BIR Form 2307 generator takes one payee listing — tour guides, transport contractors, and any other withheld vendor, each with their own ATC code — and produces every certificate from that single upload, rather than requiring a separate workflow per vendor type.
Summary #
A travel agency or tour operator carries three distinct withholding questions in the same booking cycle: a freelance tour guide’s fee (5%/10% professional fee), a transport contractor’s fee (2% general contractor), and office rent (5% rental) — three different ATC families, not one blanket rate. A VAT-registered agency has a further RELIEF SLSP duty on its package-tour sales and purchases. See BIR Form 2307 for Travel Agencies and Tour Operators for the payee-side detail on how a guide or supplier should expect to be withheld.
