BIR Online Tools for Agricultural Input and Farm Supply Retailers

A farm supply retailer selling fertilizer, seed, and animal feed is also selling VATable products in the same till — tools, irrigation parts, fencing, and specialty pet or aquarium feed — and the two categories need to be tagged and filed separately rather than treated as one blanket VAT line. NIRC Section 109(B) exempts the farm-input side from 12% VAT; the rest of the store’s inventory stays VATable and belongs on RELIEF SLSP. On top of that split, the store has its own withholding duty on vendors like delivery haulers and warehouse lessors — a separate task from the VAT question entirely.

Which products in a farm supply store are VAT-exempt? #

Fertilizer, seed, seedlings, fingerlings, and the feed (and feed ingredients) used for food-producing livestock, poultry, fish, and prawns are exempt from VAT under NIRC Section 109(B) — but specialty feed for pets, aquarium fish, race horses, and fighting cocks is carved out and stays taxable. This site covers the exemption itself in depth in Are Fertilizers, Seeds, and Animal Feeds VAT-Exempt? NIRC Section 109(B) Explained; the line that matters for a retailer’s day-to-day filing is the exact statutory wording:

“Sale or importation of fertilizers; seeds, seedlings and fingerlings; fish, prawn, livestock and poultry feeds, including ingredients, whether locally produced or imported, used in the manufacture of finished feeds (except specialty feeds for race horses, fighting cocks, aquarium fish, zoo animals and other animals generally considered as pets).”

— NIRC Section 109(B)

Why does the exempt/VATable split matter for filing? #

A VAT-registered farm supply store reports its VATable sales on RELIEF SLSP, but its exempt fertilizer, seed, and feed sales generate no output VAT and sit outside that filing — so the two product categories can’t be uploaded as one undifferentiated sales file. Mixing them produces a RELIEF SLSP that overstates VATable sales (if exempt lines are wrongly included) or an understated output VAT liability (if VATable lines are wrongly excluded) — either version is a reconciliation flag against the store’s VAT returns. What Is RELIEF SLSP? covers the filing mechanics in full.

In BIR Online Tools’ RELIEF module, a retailer tags each sales line by product category before the DAT file is generated, so the exempt fertilizer/seed/feed total and the VATable tools/specialty-feed total are split automatically rather than requiring a manual spreadsheet filter every quarter.

Does the store still have to withhold tax on its own vendors? #

Yes — a farm supply store’s VAT-exempt sales have nothing to do with its separate duty, as a withholding agent, to withhold on vendors it pays for services such as hauling, delivery, or warehouse rental. The test is the same one that applies to every withholding agent under the regulations:

“(A) In general, any juridical person, whether or not engaged in trade or business; (B) An individual, with respect to payments made in connection with his trade or business…”

— RR No. 2-98, Section 2.57.3(A)–(B)

A farm supply store organized as a corporation or operating as a registered sole proprietorship falls squarely under this test once it pays a vendor for a withholdable service — the VAT status of the store’s own sales doesn’t change that obligation.

Worked example: one store, two filings #

AgriGrow Farm Supply, a VAT-registered dealer, posts the following sales in one quarter:

LineAmountTreatment
Fertilizer and certified seed₱620,000Exempt — excluded from RELIEF SLSP
Broiler and hog feed₱310,000Exempt — excluded from RELIEF SLSP
Irrigation hose, hand tools, fencing wire₱180,000VATable — reported on RELIEF SLSP
Premium aquarium and pet feed₱40,000VATable — reported on RELIEF SLSP

Only the ₱220,000 in tools and specialty pet feed, plus the ₱26,400 output VAT on that amount, goes into AgriGrow’s RELIEF SLSP for the quarter; the ₱930,000 in fertilizer, seed, and food-animal feed sales stays off that filing entirely.

That same quarter, AgriGrow pays its regular delivery contractor ₱60,000 to haul fertilizer and feed sacks to customer farms and withholds 2% expanded withholding tax (₱1,200), issuing the hauler a BIR Form 2307 through the bulk certificate generator — a transaction that has no connection to AgriGrow’s own VAT-exempt sales and would still apply even if AgriGrow sold nothing but fertilizer all quarter.

Pre-filing checklist #

  1. Tag every sales line as exempt (fertilizer/seed/food-animal feed) or VATable (tools, equipment, specialty pet feed) before building the RELIEF SLSP DAT file.
  2. Confirm specialty feed for pets, aquarium fish, or race/fighting animals is coded VATable, not swept into the exempt feed category.
  3. Exclude confirmed-exempt sales from the RELIEF SLSP total, keeping only VATable sales and their output VAT in the filing.
  4. Identify vendors the store itself withholds on — hauling, delivery, warehouse rental — and confirm each vendor’s TIN and ATC code.
  5. Issue BIR Form 2307 to those vendors through the bulk generator, independent of how the store’s own sales are classified for VAT.

Frequently asked questions #

Does a farm supply store charge VAT on fertilizer and seed? #

No. NIRC Section 109(B) exempts the sale or importation of fertilizers, seeds, seedlings, fingerlings, and food-animal feed (including the ingredients used to manufacture finished feed) from 12% VAT, whether locally produced or imported. A farm supply store does not charge output VAT on these specific product lines.

Are all the products a farm supply store sells VAT-exempt? #

No. Only the specific inputs listed in NIRC Section 109(B) are exempt. Tools, irrigation equipment, fencing, non-exempt agrochemicals, and specialty feed for pets, aquarium fish, race horses, or fighting cocks remain subject to 12% VAT, so a typical farm supply store runs a mixed VAT-exempt and VATable inventory.

Does a farm supply retailer still file RELIEF SLSP if part of its sales are VAT-exempt? #

Yes, if the store is VAT-registered. RELIEF SLSP reports VAT-registered sales and purchases; a retailer with both VAT-exempt and VATable lines reports the VATable portion on RELIEF SLSP while the exempt-sales portion is excluded from output VAT, so the two categories need to be tagged separately before the DAT file is built.

Does a farm supply store need to withhold tax even though it’s mostly a retailer? #

Yes, once it qualifies as a withholding agent under RR No. 2-98. A farm supply store that pays a hauling contractor to deliver fertilizer and feed to customers, or that pays rent on a bodega or warehouse, must withhold expanded withholding tax on those payments and issue BIR Form 2307 to the vendor, regardless of the VAT treatment of the store’s own sales.

Summary #

A farm supply retailer runs two separate compliance tracks at once: splitting VAT-exempt fertilizer, seed, and food-animal feed sales from VATable tools and specialty pet feed before filing RELIEF SLSP, and separately withholding on vendors like hauling contractors and warehouse lessors regardless of its own VAT mix. BIR Online Tools’ RELIEF module tags and separates the two sales categories automatically, while the bulk BIR Form 2307 generator covers the certificates the store issues outward to its own vendors.
