BIR Form 2307 for Swimming Pool Maintenance and Water Treatment Services: Recurring Contract Withholding

A hotel, condominium, resort, or gym that engages a pool maintenance or water treatment company for recurring cleaning, chemical dosing, and filtration-system upkeep withholds 2% expanded withholding tax (EWT) on the service fee, under Section 2.57.2(E) of Revenue Regulations (RR) No. 2-98, as amended by RR No. 11-2018 — the same general contractor/business-services bracket this series covers for pest control and waste hauling and elevator and escalator maintenance contracts.

This guide is part of the BIR Form 2307 series. It covers why a pool maintenance contract falls under the 2% general-service bracket, how this differs from a straight chemical or equipment purchase, and a worked hotel pool-maintenance example.

Is a pool maintenance contract a withholdable service? #

Yes — recurring pool cleaning, water testing, chemical dosing, and filtration-system upkeep is a contracted business service, and payments to the provider fall under the same general contractor/business-services item this series applies to other recurring building-maintenance contracts. RR No. 2-98 sets the withholding-agent test broadly enough to cover any business paying for this kind of recurring service:

“(A) In general, any juridical person, whether or not engaged in trade or business; (B) An individual, with respect to payments made in connection with his trade or business…”

— RR No. 2-98, Section 2.57.3(A)–(B)

A hotel retaining a pool service company to maintain its guest pool, a condominium corporation contracting a water-treatment provider for its amenity pool, or a gym engaging a maintenance contractor for its lap pool are all paying for a recurring contracted service under this bracket — the same treatment this series documents for CCTV and security monitoring and other building-service contracts.

What ATC code and rate apply to pool maintenance? #

The service fee is withheld at 2%, using the same general contractor/business-services codes applied throughout this series to other recurring building-maintenance contracts, depending on whether the provider is individually owned or a corporation.

PayeeATCRateWithholding base
Pool maintenance/water treatment provider, individually ownedWI1202%Service/maintenance fee
Pool maintenance/water treatment provider, organized as a corporationWC1202%Service/maintenance fee

The rate does not scale with contract size or the number of pools covered under a single agreement — a single-pool gym contract and a multi-property resort contract both use the same WI120/WC120 codes at 2%.

Service contract vs a straight chemical or equipment purchase #

A recurring maintenance contract is withheld at 2% as a service, but an ordinary one-time purchase of pool chemicals, a replacement pump, or filtration equipment from a retail supplier is a purchase of goods, not a service, and generally falls outside expanded withholding tax unless the buyer is a BIR-designated Top Withholding Agent. This is the same goods-vs-service distinction this series covers for junk shops and scrap metal dealers:

PaymentNatureWithholding
Monthly/recurring pool maintenance and water-treatment service feeService2% EWT (ATC WI120/WC120)
One-time retail purchase of chlorine, chemicals, or a replacement pump from a supplierPurchase of goodsNone, unless the buyer is a designated Top Withholding Agent (then 1% under ATC WC158/WI158)

A hotel buying pool chemicals outright from a chemical supplier, separate from its maintenance contractor, generally does not withhold on that purchase unless it is itself a Top Withholding Agent — see BIR Form 2307 for Purchases of Goods for that separate rule.

Worked example: a resort’s monthly pool maintenance contract #

Coral Bay Resort engages AquaClear Pool Services, Inc., a pool maintenance company organized as a corporation, for a fixed monthly service fee of ₱45,000 covering daily cleaning, chemical balancing, and filtration maintenance across the resort’s three guest pools.

ItemAmount
Monthly maintenance fee₱45,000.00
EWT withheld (2%, ATC WC120)₱900.00
VAT (12% on ₱45,000)₱5,400.00
Net cash to AquaClear Pool Services, Inc. (fee + VAT − EWT)₱49,500.00

Coral Bay Resort withholds ₱900 — 2% of the ₱45,000 service fee — and remits it through BIR Form 0619-E monthly and BIR Form 1601-EQ quarterly, listing AquaClear Pool Services on its Quarterly Alphalist of Payees. If the resort separately buys a replacement pool pump directly from an equipment supplier, that purchase is a straight goods transaction and does not get folded into this 2% service computation.

Frequently asked questions #

Does a business withhold tax on a swimming pool maintenance contract? #

Yes. A hotel, condominium, resort, or gym that engages a pool maintenance or water treatment company for recurring cleaning, chemical dosing, and filtration-system upkeep withholds 2% expanded withholding tax (EWT) on the service fee under Section 2.57.2(E) of Revenue Regulations No. 2-98, as amended by RR No. 11-2018, and issues BIR Form 2307.

What ATC code applies to a pool maintenance service contract? #

The general contractor/business-services codes apply: ATC WI120 for an individually owned pool maintenance business or WC120 for one organized as a corporation, both at 2%, the same codes used throughout this series for recurring building-maintenance services.

Is a one-time purchase of pool chemicals or equipment treated the same way? #

No. A straight retail purchase of pool chemicals, a replacement pump, or filtration equipment from a supplier is a purchase of goods, not a service, and generally is not subject to expanded withholding tax unless the buyer is a BIR-designated Top Withholding Agent. Withholding applies to the labor/service component of a maintenance contract, not to an ordinary goods purchase.

Does the rate change for a large resort with multiple pools under one contract? #

No. The 2% rate and ATC WI120/WC120 apply regardless of how many pools a single maintenance contract covers or how large the recurring billing is — the rate is not tiered by contract size, only by whether the payee is an individual or a corporation.

Summary #

A swimming pool maintenance or water treatment service contract is withheld at 2% (ATC WI120/WC120) as a general contracted business service under RR No. 2-98 — the same bracket covering pest control, elevator maintenance, and other recurring building-service contracts. A one-time retail purchase of chemicals or equipment is a different transaction (a goods purchase) that generally falls outside this withholding unless the buyer is a Top Withholding Agent. For the broader contractor bracket this draws from, see BIR Form 2307 for Contractors and Subcontractors, and for the parallel recurring-service pattern, see BIR Form 2307 for Pest Control and Waste Hauling Services.
